You may not sell or modify the Web Site Content or reproduce, display, publicly perform, distribute or otherwise use the Web Site Content in any way for any public or commercial purpose. You shall not copy or adapt the HTML code that SnapCampus Ltd creates to generate any Web Site Content or the pages making up any SnapCampus Site.

Acceptable Site Use.

General Rules: Users may not use the Web Site in order to display, transmit, distribute, store or destroy material including, without limitation, Web Site Content, (a) in violation of any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others or (c) that is, or may in our judgment be, defamatory, offensive, vulgar, obscene, harassing, threatening, abusive or hateful, racist, sexist, discriminatory, of a menacing character or cause annoyance, inconvenience, embarrassment or anxiety to any person.

You are authorised to view and use the Site and the Services, provided it is for lawful purposes relating to seeking employment, information, or advertising solutions.

You may not use the Site for any other purposes to transmit, distribute, store or destroy any material posted on this Site.

You ensure that any information that you send to SnapCampus or to any advertiser, it is accurate and legal.

Specific Prohibited Uses.

  • Posting any incomplete, false or inaccurate biographical information or information which is not your own accurate CV.
  • Posting any franchise, membership, distributorship or sales representative agency arrangement or other business opportunity which requires an upfront or periodic payment, pays commissions only (no significant salary), requires recruitment of other members, sub-distributors or sub-agents. Or using the profile database to promote, encourage or sell franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement or other business opportunity requires an upfront or periodic payment, pays commissions only (no significant salary), requires recruitment of other members, sub-distributors or sub-agents.
  • Using SnapCampus profile pages to send unsolicited mail or e-mail, making unsolicited phone calls or sending unsolicited faxes regarding promotions and/or advertising of products or services to a user of a SnapCampus Site.
  • Using any device, software or routine to interfere or attempt to interfere with the proper working of SnapCampus.com or any activity being conducted on this Web Site.
  • Taking any action which imposes an unreasonable or excessively large load on SnapCampus infrastructure.
  • If you have a password allowing access to a non-public area of this Web Site then any disclosure or sharing of your password with any third parties or using your password for any unauthorised purpose is prohibited.
  • Attempting to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of any SnapCampus Site.
  • Aggregating, copying or duplicating in any manner any of the Web Site Content or information available from any SnapCampus Site.
  • Framing of or linking to any of the Web Site Content or information available from any SnapCampus Site.
  • Posting jobs located in countries subject to economic sanctions of the United States Government or Federal Governments of specific states from time to time.
  • Posting jobs which require the applicant to provide information relation to his/her (i) racial or ethnic origin (ii) political beliefs (iii) philosophical or religious beliefs (iv) membership of a trade union (v) physical or mental health (vi) sexual life (vii) the commission of criminal offences or proceedings or (vii) age.

User Information.

When you register with Web Site, you will be asked to provide SnapCampus with certain information including, without limitation, a valid email address (your "Information"). In addition to the terms and conditions that may be set forth in any privacy policy on this Web Site, you understand and agree that SnapCampus may disclose to third parties, on an anonymous basis, certain aggregate information contained in your registration application. SnapCampus will not disclose to any third party your name, address, e-mail address or telephone number without your prior consent, except to the extent necessary or appropriate to comply with applicable laws or in legal proceedings where such information is relevant. SnapCampus reserves the right to offer third party services and products to you based on the preferences that you identify in your registration and at any time thereafter; such offers may be made by SnapCampus or by third parties. User Submissions.

As a user of the site you accept responsibility for your own communications and are responsible for the consequences of their posting. You must not, and by using www.snapcampus.com you agree not to, do the following things: post material that is copyrighted except if you are the copyright owner or have the acquiescence of the copyright owner to post it; post material that reveals trade secrets unless you own them or have the consent of the owner; post material that infringes on any other intellectual property rights of others or on the privacy or publicity rights of others; post material that is obscene, offensive, vulgar, defamatory, threatening, harassing, abusive, hateful, racist, sexist, discriminatory, of a menacing character or embarrassing, or which may cause annoyance, anxiety or inconvenience to another user or any other person or entity; post a sexually-explicit image or statement; post advertisements or solicitations of business; post chain letters or pyramid schemes; impersonate another person; or post material that contains viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines or engines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information.

SnapCampus reserves the right, to change, amend or cancel any member's profile, posting or input to the site if their content is considered to be in conflict with the above outlined conditions.

SnapCampus does not represent or guarantee the truthfulness, accuracy or reliability of communications posted by users or endorse any opinions expressed by users. You acknowledge that any reliance on material posted by other users will be at your own risk.

SnapCampus acts as a passive conduct for the online distribution and publication of user-submitted information and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring material posted by users. If us (the "Company") are notified by a user of communications which allegedly do not conform to these Terms and Conditions, SnapCampus may investigate the accusation and determine in good faith and its sole discretion whether to remove or request the removal of the communication. SnapCampus has no liability or responsibility to users for performance or nonperformance of such activities. SnapCampus reserves the right to expel users and prevent their further access to the Web Site for violating the Terms and Conditions or the law and the right to remove communications which are abusive, illegal or disruptive. SnapCampus may take any action with respect to user-submitted information that it deems necessary or appropriate in its sole discretion if it believes it may create liability for SnapCampus.

By submitting content to any public or non-public area of any SnapCampus Site, including message boards, forums, contests and chat rooms, you allow SnapCampus and its affiliates the loyalty-free, perpetual, irrevocable, sublicenseable (through multiple tiers), non-exclusive right (including any moral rights) and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or later developed for the full term of any rights that may exist in such content. Please be advised, however, that our policy does not permit us to accept or consider creative ideas, suggestions inventions or materials other than those which we have specifically requested. While we do value your feedback on our services, please be specific in your comments regarding our services and do not submit creative ideas, inventions, suggestions or materials. If, despite our request, you send us creative suggestions, ideas, drawings, concepts, inventions or other information (collectively the "Submission"), the Submission shall be the property of SnapCampus. None of the Submission shall be subject to any obligation of confidence on our part and we shall not be liable for any use or disclosure of any Submission. Registration and Password.

You are responsible for maintaining the confidentiality of your information and password. You shall be responsible for all uses of your registration whether or not authorised by you. You agree to immediately notify SnapCampus of any unauthorised use of your registration or password.

Policy Regarding Termination Of Users And Account Holders Who Repeatedly Infringe The Copyright Or Other Intellectual Property Rights Of Others.

SnapCampus respects the intellectual property of others and we ask our users, account holders and content partners to do the same. The unauthorised reproduction, copying, distribution, modification, public display or public performance of copyrighted works constitutes infringement of the copyright owners rights. As a condition to your use of this Web Site, you agree not to use the Web Site or any other SnapCampus Site to infringe the intellectual property rights of others in any way. We will terminate the accounts of any account holders and block access to our Web Site and/or the other SnapCampus Sites of any users who repeatedly infringe the copyright or other intellectual property rights of others. We reserve the right to take these actions at any time, in our sole discretion, with or without notice and without any liability to the account holder who is terminated or to the user whose access is blocked.

SnapCampus Liability.

SnapCampus Sites are only a venue. This Web Site acts as a venue for employers to post job opportunities and candidates to post CV's and does not screen or censor the listings offered. SnapCampus is not involved in the actual transaction between employers and candidates. As a result, SnapCampus has no control over the quality, safety or legality of the jobs or CV's posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings. In addition, note that there are risks including, but not limited to, the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretences. You assume all risks associated with dealing with other users with whom you come in contact through the Web Site and/or the other SnapCampus Sites.

Because user authentication on the Internet is difficult, SnapCampus cannot and does not confirm that each user is who they claim to be. Because we do not and cannot be involved in user-to-user dealings or control the behaviour of participants on any SnapCampus Site, in the event that you have a dispute with one or more users, you release SnapCampus (and our agents and employees) from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

We are under no legal obligation to, and generally do not, control the information provided by other users which is made available through the Web Site and the other SnapCampus Sites. By its very nature, other people's information may be offensive, harmful or inaccurate and in some cases will be mislabelled or deceptively labelled. SNAPCAMPUS DOES NOT WARRANT THAT THE WEB SITE WILL OPERATE ERROR-FREE OR THAT THE WEB SITE AND ITS SERVER ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. No Resale or Unauthorised Commercial Use.

You agree not to resell or assign your rights or obligations under these Terms and Conditions. You also agree not to make any unauthorised commercial use of any SnapCampus Site.

Limitation of Liability.

TO THE EXTENT PERMITTED BY LAW, THE COMPANY'S MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH ANY JOBSFROMBLUE SITE OR YOUR USE OF THE WEB SITE CONTENT, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY OR OTHERWISE), WILL NOT EXCEED £100.

Termination.

SnapCampus reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to deletion of your postings from this Web Site and other SnapCampus Sites and/or immediate termination of your registration with or ability to access the Web Site and other SnapCampus Sites and/or any other service provided to you by SnapCampus, upon any breach by you of these Terms and Conditions or the terms and conditions of any SnapCampus Site or if SnapCampus is unable to verify or authenticate any information you submit to the Web Site registration Or other SnapCampus Site registration.

Indemnity.

You agree to defend, indemnify and hold harmless SnapCampus, its officers, directors, employees and agents from and against any claims, actions or demands including, without limitation, reasonable legal and accounting fees, alleging or resulting from (i) any material you provide to a SnapCampus Site, (ii) any Web Site Content that you use or (iii) your breach of the terms of these Terms and Conditions. SnapCampus shall provide notice to you promptly of any such claim, suit or proceeding and shall assist you, at your expense, in defending any such claim, suit or proceeding.

General.

SnapCampus makes no claims that the Web Site Content may be lawfully viewed or downloaded outside of the United Kingdom. Access to the Web Site Content may not be legal by certain persons or in certain countries. If you access the Web Site from outside of the United Kingdom, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. These Terms and Conditions are governed by the law of England and Wales. Jurisdiction for any claims arising under this agreement shall lie exclusively with the English Courts. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions which shall remain in full force and effect. No waiver of any term of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided in additional terms of use for areas of the Web Site, a particular "Legal Notice" or Software License or material on particular Web pages, these Terms and Conditions constitute the entire agreement between you and SnapCampus with respect to the use of Web Site. No changes to these Terms and Conditions shall be made except by a revised posting on this page. SnapCampus entitles users complete use of the site and its services free of charge. SnapCampus reserves the right to deactivate, modify and/or upload content on behalf of its users.

Advertisers:

Advertisers; Recruiters/direct employers/affiliates/companies/any persons who sign up, create, manage, post vacancies, profiles, promotions on www.snapcampus.com is in charge of managing such advertising and will be held responsible for any breach of these terms and conditions.

  1. Definitions

    In these terms and conditions the following words and phrases shall have the following meanings unless the context requires otherwise:-

    Candidate:
    A person who applies for a Jobsfromblue advertised vacancy on any job board site, affiliated job board site, Jobsfromblue site or other online site or through any electronic communication
    Client:
    Any person, company or firm which agrees to use the Service.
    CV:
    The curriculum vitae or brief outline details of a Candidate's education, training, skills and employment experience which is provided to Jobsfromblue by a Candidate for distribution to Clients with a view to securing employment.
    Fees:
    The fees and charges payable by the Client as specified in these Terms.
    Terms:
    These Terms and Conditions.
    Vacancy:
    A role described/worded/ constructed and/or on behalf of an organisation.
    Profile:
    A corporate profile that hosts your vacancies and acts as on online Control Panel.
    Application:
    Information provided by Jobsfromblue to supplement the Candidate's CV (cover letter, availability questions)
    SnapCampus:
    SnapCampus Limited (company number 7075638, 145-157 St Johns Street, London, EC1V 4PY).
  2. Contract

    These terms relate to the online advertising service ("the Service") provided by SnapCampus.

    These Terms constitute the contract between SnapCampus and the Client and are deemed to be accepted by the Client by virtue of confirmation of your acceptance of these Terms, making payment, requesting an invoice to be raised, approving or adding/uploading/amending the Profile.

    These terms contain the entire agreement between the parties and unless otherwise agreed in writing by a director of SnapCampus, these Terms of Business prevail over any previous terms of business or purchase conditions put forward by the Client.

    No variation or alteration to these Terms shall be valid unless the details of such variation are agreed between SnapCampus (Director of SnapCampus) and the Client and are set out in writing and stating the date on or after such varied terms shall apply.

  3. Using our Service

    If you send a Vacancy to us we may contact you to discuss your role in more detail and or to inform you if we are not able to accept the Vacancy for any reason.

    Once you have accepted our Terms and agreed payment, we will liaise with you to create the 'Profile' for your approval. Once the Profile is approved we will:

    • Promote the position on our and relevant web sites in our XML feed.
    • Promote the vacancy via emailing campaign to our candidate database.

    In order that we can deliver our service to you, SnapCampus can place your Vacancy on any website or on any other media controlled by us or by any third party with whom we have, or enter into, an agreement for the provision of services for the purpose of filling the Vacancy.

    You understand that:

    • The Vacancy can be viewed by anyone with Internet access throughout the world
    • SnapCampus cannot guarantee a particular level of success to a Vacancy; and response rates vary from day to day and certain sectors or positions may attract higher levels of responses than others.
  4. Your vacancy

    Your Vacancy Profile must be legal, decent, honest and truthful and not infringe the rights of any third party.

    Any Vacancy which indicates, or can reasonably be understood as indicating, an intention to discriminate on grounds of sex, race, disability or age will not be accepted unless it is exempted from the requirements of the Sex Discrimination Act or the Race Relations Act or Disability Act or the Age Discrimination Act. A statement must be made at the time the Vacancy is placed or Service used saying which of the exemptions in the Act(s) is considered to apply.

    Vacancies will appear branded on SnapCampus and any other websites that we have individual agreements with to brand vacancy. No emails or details of the client shall be shown within the vacancy and that all applications shall be forwarded to the client directly.

    You agree SnapCampus may need to modify the 'Profile' and the key word tagging in order to optimise your vacancy for job board searching and to attract suitable Candidates.

  5. Candidates

    Candidate CVs and Application Forms will be forwarded by SnapCampus by e-mail and will not be subject to any filtering and screening. SnapCampus will use its best endeavours to:

    • Confirm the Candidate availability for the vacancy
    • Confirm the candidates eligibility to work in the UK
    • SnapCampus shall not be responsible nor will it view any of the content held in the candidates CV

    The Client accepts that, following any contact with Candidates:

    • It shall be up to the Client and the Candidate to agree how to progress matters
    • The Client shall act in good faith and in a businesslike and courteous manner
    • The Client shall keep strictly confidential all confidential information disclosed by the Candidate and act in accordance with the Data Protection Acts.
  6. Payment

    For single vacancies payment is upfront against a pro-forma invoice. Payment is accepted by credit card, BACS or cheque. SnapCampus will not start work on your vacancy until payment has been received.

    For multi-vacancy advertising and subject to credit approval and volume of vacancies, payment is on Account. Account terms are 30 days from date of invoice.

    In the event that payment is not made on time SnapCampus will:

    • Suspend any work on any current or new vacancy adverts until payment has been made. This will include not providing any CV Applications and your Vacancy will be removed from online resources, including all other job boards, advertising sites, social networks and blogs.
    • Any money back guarantee shall be null and void.
    • you will be charged interest on the outstanding balance at the rate of 2% per annum above the base rate of Barclays Bank PLC accruing from day to day (including the date on which payment was due) both before and after judgment.
  7. Fees

    The SnapCampus standard service fee are viewable upon login and can be subject to negotiation based on user requirements and commitment lengths.

    We will work on your vacancy for 4 weeks commencing on the start date which is the date of approval ending 28 days later.

  8. VAT

    All Fees are exclusive of any Value Added Taxes or other applicable sales tax. Valued Added Tax will be charged at the applicable rate.

  9. Guarantee

    SnapCampus cannot guarantee the results of any advertising campaigns with the website and will not be held liable for any campaigns that fail to deliver the client 'deemed' suitable outcome.

  10. Cancellations and interruptions

    You have the right to withdraw the Vacancy for any reason at any time. You will not be subject to a refund and any outstanding balances will be due unless the above Guarantee applies and a Zero Response result has occurred.

    You acknowledge that the Internet and/or SnapCampus systems, services and equipment may from time to time be inoperative in full or in part as a consequence of but not limited to, mechanical breakdown, maintenance, hardware or software upgrades, communication connectivity problems or other factors beyond the control of SnapCampus and you acknowledge that SnapCampus will not be held liable for any failure or inability to provide continuous, error free, uninterrupted services under these circumstances.

  11. Liability

    Our liability to you for breach of contract or negligence shall not exceed an amount equal to our fees for any Vacancy or series of Vacancies regarding the same matter placed by you with SnapCampus. In no event shall we be liable for any special, indirect, consequential or loss whatsoever or any loss of profit regardless of whether such losses are foreseeable and whether or not caused by our negligence arising out of or in connection with the use of the Service. Nothing contained in these Terms shall have effect so as to limit our liability for loss or damage arising out of personal injury or death or acts of fraud.

    All and any interaction and communication between the Client and any Candidate and in connection with the Candidate's response to the Vacancy are the responsibility of the Client, and SnapCampus accepts no liability whatsoever therewith. The Client will indemnify SnapCampus against any Losses in connection therewith.

    Having in mind the nature of the service, we are not able to verify any statements made by you in your Vacancy Profile and accordingly you agree to indemnify us from all claims, costs and expenses (including legal expenses) resulting from your breach of these Terms.

    While SnapCampus endeavours to ensure that the information on its website is correct, SnapCampus does not warrant the accuracy and completeness of that information. SnapCampus may make changes to the material on this website at any time without notice. The material on this website may be out of date, and SnapCampus makes no commitment to update such material. Please note that you will be required to use caution, common sense and good awareness as there are also risks of dealing with persons or people acting under false pretences. By using the website you agree to all risks and agree that SnapCampus is not responsible for the acts or omissions of others.

  12. Termination

    This Agreement may be terminated by SnapCampus if:

    • After providing written notice to the Client of breach of these Terms, such breaches are not rectified within 5 working days by the Client.
    • The Client fails to pay SnapCampus on the due date any sums that may be due.
    • The Client makes any material misrepresentation.
    • The Client is using the service for any improper use or with the intention to damage the reputation of the Services provided by SnapCampus.
  13. Viruses

    SnapCampus will take reasonable care not to transmit viruses or malware to you but it is your responsibility to protect you computers against viruses or malware. Accordingly you agree that SnapCampus will not be liable to you for any damage resulting from the transmission from us to your computer systems of viruses, or malware.

  14. Third Party Rights

    A person who is not a party to this contract shall not have any rights under or in connection with it.

  15. Complaints

    SnapCampus has a formal complaints procedure which can be provided on request. Should you be dissatisfied with any aspect of the service raise this with your Account Manager in the first instance and thereafter can be escalated to the Director, Client Operations.

  16. Equal Opportunities and Diversity Policy

    Jobsfromblue maintains an equal opportunities policy which can be provided on request. SnapCampus is committed to diversity and will promote diversity for all Clients and Candidates and shall adhere to such a policy at all times. SnapCampus will not accept instructions from clients that indicate an intention to discriminate unlawfully.

  17. Governing Law

    These Terms and the contract of which they form a part shall be governed by English law and shall be subject to the non-exclusive jurisdiction of the English courts.
